By downloading or using Ocean Insight ("the App"), you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the App.
1. Provider

2. Scope of Use
Ocean Insight is a nature education mobile application ("App") that presents ocean species information, daily challenges, achievements, and prehistoric trophies. The App is available for iOS (App Store) and Android (Google Play).
3. Free and Premium Features
3.1 Free Tier
The App is free to download. Free users have access to:
- The daily species discovery feature
- Standard achievements
- IUCN-verified species facts
Free users will see advertisements served by Google AdMob. By using the App, you agree to the display of these ads (subject to your consent for personalised ads).
3.2 Premium ("Ocean Insight Premium")
A Premium subscription or one-time purchase unlocks:
- Ad-free experience
- Prehistoric trophy category (Urzeit-Trophäen)
- Additional achievements and exclusive content
- Future Premium features as released
Premium is purchased through the App Store or Google Play and is subject to their respective terms.
4. In-App Purchases and Refund Policy
In-app purchases are processed by Apple (App Store) or Google (Google Play). Once a digital purchase has been consumed or the associated content has been unlocked, refunds are not available, except as required by applicable law or the respective store's refund policy.
For refund requests, please contact Apple or Google directly via their support channels. We are unable to process refunds directly.
Subscription cancellations take effect at the end of the current billing period. No partial refunds are given for unused subscription time.
5. Age Recommendation
Ocean Insight is rated suitable for all ages with adult supervision recommended for children under 8. The App does not require registration or an account. Parents and guardians are encouraged to supervise children's in-app purchase activity.
6. License Grant
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited licence to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute the App or its content
- Reverse-engineer, decompile, or disassemble the App
- Use the App for commercial purposes
- Transfer your licence or account to another person
- Use the App in any way that violates applicable law
7. Intellectual Property
All content within the App — including species illustrations, audio narration, text, UI design, and the Ocean Insight name and logo — is owned by Tom Göckeritz or its licensors and is protected by applicable intellectual property laws. IUCN data is used under the IUCN Red List Terms and Conditions.
8. Disclaimer of Warranties
The educational content in Ocean Insight is provided "as is" and for informational purposes only. While we strive for accuracy using IUCN-verified data, we make no warranties, express or implied, as to the completeness, accuracy, or fitness for a particular purpose of any species information. Scientific classifications may change; always consult primary sources for critical research.
The App is provided without warranty of uninterrupted availability or freedom from errors.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Tom Göckeritz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or interruption of use. Our total liability shall not exceed the amount paid by you for the App in the twelve months preceding the claim.
10. Changes to the App and Terms
We reserve the right to modify the App, its features, or these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date above.
11. Termination
We reserve the right to suspend or terminate your access to the App if you breach these Terms. You may stop using the App at any time by uninstalling it.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The exclusive place of jurisdiction for any disputes arising from or in connection with these Terms is Germany, to the extent permitted by law.
If you are a consumer resident in the EU, you benefit from mandatory consumer protection provisions of the law of your country of residence.
